FCA: We had 'access' to the Collateral platform since October 2016 [Day 6]^Belated coverage of day 6 of the trial. An FCA case worker, in his first afternoon in the witness box, has confirmed that the FCA was given 'access' to the Collateral platform in October 2016, and had been given a copy of the company's loan book. Concerned were raised that there appeared to be links between borrower companies and the Curries themselves.

Peter Currie is understood to be making an application to vary his bail conditions tomorrow morning at Southwark Crown Court.
The hearing is scheduled to last for 30 minutes and barristers representing the parties will be appearing over video link.

Do you have any info regarding this application please? I certainly don't. The question I have asked myself, 'why make this application' with just a matter of days to go until the sentencing hearing?' (set for this Friday) There is only one logical answer to that question. But as I have found out over the last five and a half years logic is not always applicable wrt Col.

Change the conditions so he can go on a short break to Spain or where ever, "of course I'll come back for sentencing"

I understand application to vary bail conditions was granted, and the case is not under appeal.
Sentencing is due tomorrow at 2pm in front of His Honour Judge Griffith.

Currie bro's due to be sentencedAndrew and Peter Currie are expected to be sentenced tomorrow at Southwark Crown Court after being found guilty by a jury of fraud offences a few weeks ago. It can now be revealed that at a preliminary hearing at Westminster Magistrates Court in January 2022 Ms MacDonald, the barrister representing the Financial Conduct Authority, had told District Judge Clark that they sought a " sentence in excess of 7 years". Developments in the case in the intervening time may have altered this. For counts one and two, both offences under section one of the Fraud Act, the judge is likely to have regard to the sentencing guidelines to determine the outcome for each defendant. Live issues for the first two counts are likely to include the culpability of each defendant, the level of harm caused, and how any personal mitigation may affect or reduce the sentence. After some very generous donations, and with only a small amount outstanding, we have a journalist booked to cover the sentencing, expected to commence at 2pm. We will report the headline sentence as it comes in followed by a full report later on. There's no guarantees in the legal system so it may well be that the hearing is adjourned - watch this space.

It is understood that the sentencing hearing has been adjourned until Friday 14th July 2023.
This is due to previous cases overrunning.
The defendants continue to remain on bail.
