(Yawn) Ah! Where was I? Oh, yes. Thanks to all for their kind (and cautionary) comments. The system meant I could not even lurk and read the forum, so I was not aware of the followup to my slapping. I was going to lurk with another IP address from Cambridge while hobnobbing with the intellectual "aristocracy" (including this guy, absolutely fascinating!!) but didn't take my laptop (I haven't caught up with tablets yet). Talking of tablets, elljay says I can join in again if I behave, and take my tablets properly.

Glad you're back - your contributions have been missed! I was planning to upload some banana pictures to entice you back - wow, there are some great bananas out there - but thankfully you've saved me the bother of working out how to do it. I was going to ask the neighbours' four year old.

Well, a lot happens here in a week or so. Not being a frequent visitor, the OG ban passed me by completely. I am too late to vote but I would have voted for immediate reinstatement. There's too much sensitivity and pussy footing around here. People are frightened to death of lawyers. No one can say what they think. Small wonder I nose around here rarely.

If I had, I might have expressed mild disappointment in min for missing out on the smirky thread title of "Old Grumpy Bananad" (in the best traditions of the Daily Mirror etc).

I can understand your point of view chielamangus, but could I infer from it that if the moderation team (who are giving their own free time to do the job) adopt a lighter touch to forum rules, and a member posts something that does attract the attention of litigation lawyers, you'd be willing to make a voluntary contribution to a forum legal fund...?

Old Grumpy was not banned for libelling anyone - it was for being judged to have broken the naming rules which are a consequence of lenders' undertakings to FC. I think we can assume that FC taking its lenders to court for identifying the C**** S****** would be rather close to its last resort. Not good publicity. Perhaps I am easily amused but I did not find that the entertainment value of Grumpy's many posts was that much greater in the two where he (allegedly) fell foul of the naming rules. The permanent loss of the Prime Primate to the forum through technical transgressions would have diminished the board far more than the actually transgressions excited us. What was exciting and entertaining was the crisis of banning and reinstatement, but it could have ended badly and damaged the forum. There is plenty of scope within the rules. Old Grumpy has demonstrated that many times. Let's play nicely, but not too nicely.

Ah, Jimbo! I fight my own battles and expect everyone else to fight their's. But explain the legal point to me - if I say something on this forum that a company/lawyer does not like, who is collared, me or the forum owners? Who are the owners anyway? I have no wish to entangle third parties because of my opinions. Surely, if every remark posted here was prefaced with a disclaimer along the lines of "Responsibility for the comment posted below rests with me alone. The comment does not necessarily reflect the thinking of the forum owner, its managers or its members, and they are not in anyway responsible for the content". Would not this be enough to restore freedom of expression?
I think I am on record somewhere on this forum that I don't trust and don't like the legal profession. So far in legal disputes I am leading 3-0, with a couple of draws. I always represent myself and never take legal advice. I have found that in most cases the legal profession backs down fairly smartly when they come across determined resistance from a private individual. They hate dealing with 'em! They'd much prefer a cosy arrangement with someone else's lawyers, with everyone racking up fees.

Both the publisher of the forum and the author of the post can be sued if anyone is defamed. I do not know who counts as the publisher(s) but can understand the moderators' nervousness.
